By purchasing, downloading, installing, or using CosmicWriter you agree to be bound by this EULA. If you do not agree, do not install or use the Software and contact [email protected] for a refund within the refund window.
Subject to your compliance with this EULA and payment of the applicable fee, Developer grants you a limited, non-exclusive, non-transferable, revocable license to:
Your license key may be activated on a maximum of two (2) machines simultaneously. To activate on a new machine, you must first deactivate the Software on one of your existing activated machines via Settings → License → Deactivate.
You may not:
The Software is licensed, not sold. Developer retains all right, title, and interest in and to the Software, including all intellectual property rights. This EULA does not grant you any rights to Developer's trademarks or service marks.
Developer may provide updates, bug fixes, or new versions of the Software at its discretion. Updates may be subject to additional or amended terms. Support is provided on a best-effort basis via email at [email protected].
This license is effective until terminated. Developer may terminate this EULA immediately and without notice if you breach any of its terms. Upon termination you must cease all use of the Software and destroy all copies in your possession. Sections 3, 4, 8, 9, and 10 survive termination.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. DEVELOPER'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THIS EULA SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Developer and their successors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Software; (b) any content you create, publish, or distribute using the Software; (c) your breach of this EULA; or (d) your violation of any third-party rights.
This EULA is governed by the laws of the State of Illinois, United States. Any disputes shall be resolved exclusively in the courts of Madison County, Illinois.
This EULA, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and Developer regarding the Software and supersedes all prior agreements.
